By creating an account or using DispatchLog at dispatchlog.net, you agree to these Terms of Service. If you do not agree, do not use the service.
DispatchLog is operated by Travis S. Lopez, an individual based in California. When these terms say "we", "us", or "our" they refer to Travis S. Lopez operating DispatchLog.
DispatchLog is a web application for dispatch tracking, pay calculation, hours logging, and mileage tracking for union construction trade workers.
DispatchLog is an independent tool and is not affiliated with, endorsed by, or operated by any employer, dispatch service, union, or labor organization.
You must sign in with a valid Google account to use DispatchLog. You are responsible for maintaining the security of your account and for all activity that occurs under it.
You must be at least 18 years old to use DispatchLog. By using the service you represent that you meet this requirement.
You may only create one account per person. Accounts are non-transferable.
You agree to use DispatchLog only for its intended purpose — tracking your own dispatches, pay, and hours as a construction trade worker.
You agree not to:
DispatchLog requires a paid subscription after the free trial period ends. Subscription fees are billed through Stripe. By subscribing you authorize us to charge your payment method on a recurring basis at the rate in effect at the time of your subscription.
Your free trial begins on the date you create your account. At the end of the trial period, you must subscribe to continue using the service.
Subscriptions renew automatically. You may cancel at any time by contacting us at [email protected] or through Stripe directly. Cancellation takes effect at the end of the current billing period. We do not issue refunds for partial billing periods.
We reserve the right to change subscription pricing with reasonable notice. Continued use of the service after a price change constitutes acceptance of the new price.
You can revoke DispatchLog's access to your Google account at any time through your Google Account settings at myaccount.google.com. Revoking access will prevent you from signing in but will not delete your DispatchLog account or data.
You retain ownership of the dispatch and pay data you enter into DispatchLog. By using the service you grant us a limited license to store and process that data solely to provide the service to you.
We do not sell your data. See our Privacy Policy at dispatchlog.net/privacy for full details on how we handle your data.
You may request deletion of your account and data at any time by contacting us at [email protected].
DispatchLog is not responsible for any discrepancy between app calculations and actual pay received. Overtime thresholds, holiday schedules, and pay rules are configured for specific union contracts and may not reflect your actual agreement. Rate history, day-type overrides, and holiday lists are user-maintained and may contain errors.
DispatchLog is not a payroll service, accounting service, or legal advisor. Nothing in this app constitutes financial, tax, or legal advice.
DispatchLog is provided "as is" without warranty of any kind. We do not guarantee that the service will be available at all times or that it will be error-free. Features may change, be suspended, or be discontinued at any time.
To the maximum extent permitted by law, Travis S. Lopez and DispatchLog shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service, even if we have been advised of the possibility of such damages.
Our total liability to you for any claims arising from use of the service shall not exceed the amount you paid us in the 12 months preceding the claim.
You may stop using DispatchLog at any time. You may cancel your subscription through your account settings.
We reserve the right to suspend or terminate your account at any time if you violate these terms or engage in conduct that we determine is harmful to the service or other users. We will make reasonable efforts to notify you before termination except in cases of serious violations.
Upon termination, your access to the service will end. Your data will remain in our database and is not automatically deleted. Contact us at [email protected] to request deletion.
Please read this section carefully. It affects your legal rights.
Except for claims that qualify for small claims court, you and DispatchLog agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the service — including disputes about their validity, applicability, or scope — shall be resolved exclusively through binding individual arbitration, not in court.
Arbitration process: Arbitration shall be conducted under the Consumer Arbitration Rules of the American Arbitration Association (AAA), as modified by these Terms. The arbitration shall take place in California, or virtually if both parties agree. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court with jurisdiction.
No class actions: You and DispatchLog agree that all claims must be brought in your individual capacity only, and not as a plaintiff or class member in any purported class, collective, or representative action. The arbitrator may not consolidate more than one person's claims and may not preside over any form of a class proceeding.
Exceptions: Either party may bring an individual claim in small claims court if it qualifies. Either party may also seek emergency injunctive or equitable relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration.
Opt-out: You may opt out of this arbitration agreement by sending written notice to [email protected] within 30 days of first creating your account. Your notice must state that you wish to opt out of arbitration. Opting out does not affect any other provision of these Terms.
These terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. To the extent court proceedings are permitted under these terms, you consent to the exclusive jurisdiction of the state and federal courts located in California.
We may update these terms from time to time. If we make material changes, we will update the date at the top of this page. Continued use of DispatchLog after changes are posted constitutes acceptance of the updated terms.
